Terms of Service

These Terms govern your access to and use of the Serge voice-based AI platform. By creating an account or using the Service, you agree to the conditions below.

0. Definitions

  • Service – the Serge voice-based AI platform.
  • User Content – recordings, text, or materials you provide while using the Service.
  • Company – Serge AI LLC.

1. Eligibility

You must be 18 years or older and legally capable of entering into this Agreement.

2. Description of Service

Serge provides AI-assisted conversational tools for coaching and reflection.

Serge is not a licensed medical or mental-health provider. For emergencies call 911 or 988 (Suicide & Crisis Lifeline).

3. Accounts & Security

  • Maintain accurate account information.
  • Keep credentials confidential.
  • We employ strong password hashing, rate limiting, and secure session management.
  • Report suspected compromise to security@serge.ai.

4. Privacy

Use of the Service is subject to our Privacy Policy. We collect only what’s needed to operate and never sell user data.

5. Acceptable Use

You agree not to:

  1. Access or use the Service unlawfully or to harass others.
  2. Attempt to disrupt, probe, or reverse-engineer the platform.
  3. Upload illegal, harmful, or confidential third-party data.

Violation may result in suspension or termination.

6. Intellectual Property

All software, models, and designs are owned by Serge AI LLC. You retain ownership of your content and grant Serge a limited license to process it solely to provide the Service.

7. Payments

The Service may be free during pilot phases. Future paid plans will include separate billing terms.

7A. Refund Policy

Free Version

AskSerge.ai offers a free version of the platform at no cost. Because no payment is collected, the free version is not eligible for refunds.

Paid Subscriptions – General Policy

AskSerge.ai subscriptions provide immediate access to premium features upon successful payment. As a result:

  • Refunds are not guaranteed
  • Refunds are evaluated case by case
  • Usage of the service may affect eligibility

All payments are processed through Stripe, and refunds are issued in accordance with Stripe’s payment processing rules.

Refund Eligibility

You may be eligible for a refund under the following circumstances:

1. Duplicate Charges

If you were charged more than once for the same subscription period, a full refund will be issued for the duplicate charge(s).

2. Platform-Wide Technical Issues

If AskSerge.ai experiences a significant technical failure that:

  • Prevents access to the paid service
  • Persists for a meaningful portion of your billing period
  • Is verified by our support team

A full or partial refund may be issued at our discretion.

3. Early Cancellation With Minimal Usage

Refund requests may be considered if:

  • The request is made within 24 hours of the initial purchase
  • Usage is minimal and within reasonable evaluation limits
  • No abuse or excessive activity is detected

Refunds under this category are subject to review and approval.

Non-Refundable Situations

Refunds will not be issued in the following cases:

  • Dissatisfaction with AI-generated responses or output quality
  • The service not meeting subjective expectations or specific use cases
  • Failure to cancel a subscription before the renewal date
  • Forgetting to cancel a subscription
  • Significant usage of paid features
  • Change of mind after purchase
  • Discovery of alternative tools or services
  • Violation of AskSerge.ai’s Terms of Service, including abuse, automation, or misuse

AI-generated outputs are probabilistic and results are not guaranteed.

Subscription Cancellations

  • Subscriptions may be canceled at any time
  • Cancellation stops future billing
  • Access remains active through the end of the current billing period
  • No prorated refunds are issued for unused time unless required by law

Refund Processing & Timing

  • Approved refunds are processed through Stripe
  • Once issued, refunds typically appear on your original payment method within 5–10 business days (depending on your bank or card issuer)
  • Stripe processing fees are non-refundable where applicable

AskSerge.ai does not control bank processing times once a refund has been submitted.

How to Request a Refund

To request a refund, please contact us at: support@askserge.ai

Include:

  • Account email
  • Date of purchase
  • Reason for the refund request

We aim to review refund requests within 5–7 business days.

Chargebacks & Disputes

Initiating a chargeback without contacting AskSerge.ai first may result in:

  • Suspension or termination of your account
  • Loss of access to current or future services

We encourage users to contact our support team to resolve issues before filing a dispute.

Policy Changes

AskSerge.ai reserves the right to update or modify this Refund Policy at any time. Changes take effect immediately upon posting to our website.

8. Termination

You may close your account anytime.

We may suspend or terminate access for violations of these Terms or for security reasons. Upon termination, stored data is deleted in accordance with our Privacy Policy.

9. Disclaimers

The Service is provided “as is.” AI responses are for informational purposes only.

Serge AI makes no warranty of accuracy, reliability, or suitability for clinical decisions.

9A. Arbitration & Dispute Resolution

Any dispute shall be resolved by binding arbitration administered by JAMS in Los Angeles County, California under its Streamlined Rules. Each party waives any right to a jury trial or class action. Either party may seek injunctive relief in court for misuse of intellectual property or confidential information.

10. Limitation of Liability

To the maximum extent permitted by law, Serge’s total liability shall not exceed amounts paid (if any) in the 12 months preceding a claim. Serge AI is not liable for indirect, incidental, or consequential damages.

10A. Export Compliance

You agree not to export, re-export, or use the Service in violation of U.S. export-control or sanctions laws.

10B. Government Use

The Service is a “Commercial Product” as defined in FAR 2.101 and is provided with only those rights applicable to commercial customers.

11. Indemnification

You agree to indemnify and hold Serge AI LLC harmless from claims arising from your misuse of the Service or violation of these Terms.

12. HIPAA Disclaimer

Unless expressly covered by a separate Business Associate Agreement, Serge is not a Business Associate and does not create or maintain “Protected Health Information” on behalf of covered entities.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Venue shall be Los Angeles County, California.

14. Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and Serge AI LLC. If any provision is found unenforceable, the remainder remains in full force and effect.
